About These Terms: These Terms govern your access to and use of the software and functions made available through the ASTRAUX in-vehicle infotainment system and related vehicle connectivity components.
These ASTRAUX In-Vehicle System Terms of Use (the “Terms”) govern your access to and use of the software and functions made available through the ASTRAUX in-vehicle infotainment system and related vehicle connectivity components.
For the purposes of these Terms:
These Terms apply to the Functions made available through the Vehicle, including Bluetooth connectivity, media playback, vehicle status displays, system settings and other embedded vehicle functions.
These Terms do not generally govern:
Separate terms may apply to those products and services.
Nothing in these Terms limits any mandatory statutory rights that you may have in relation to the Vehicle, the In-Vehicle System, digital content, digital services, product safety, product liability or consumer protection.
The provider of the In-Vehicle System and the Functions covered by these Terms is:
MAKTOUM TECHNOLOGY SARL
Address: Bureau 100537, Passage du Ponceau, 75002 Paris, France
Contact: privacy@astraux.com
The seller, distributor, authorised dealer, repair centre, telecommunications provider or third-party application provider may be a separate legal entity and may provide separate terms for the products or services that it independently supplies.
Please read these Terms before using the Functions.
Where the In-Vehicle System presents an acceptance interface, you accept these Terms by selecting “Accept”, “Agree” or another equivalent option.
Where no acceptance interface is technically available, your continued voluntary use of an optional Function after these Terms have been made available to you constitutes acceptance of the provisions applicable to that Function, to the extent permitted by applicable law.
Your ability to operate the basic driving and safety functions of the Vehicle will not be conditional on accepting terms relating solely to optional infotainment or connectivity services, except where a particular connected function is technically necessary for the safe and lawful operation of the Vehicle.
If you do not accept these Terms, you should not activate or use the optional Functions governed by them.
The Vehicle owner, lessee or lawful possessor may use the Functions and may permit other authorised drivers or passengers to use them.
You must not use the Functions unless you are legally entitled to use the Vehicle or have obtained permission from the Vehicle owner or lawful possessor.
A driver must hold any licence, permit or other qualification required under applicable law.
The Vehicle owner or primary user should make these Terms and the applicable privacy notices reasonably available to other persons who regularly use the Vehicle.
Where a Vehicle is owned or leased by a business, the business is responsible for ensuring that its authorised drivers and users are appropriately informed of these Terms.
The In-Vehicle System provides a minimalist interface designed to prioritise driver safety and ease of use. The main interface includes quick-access entries for system updates, Bluetooth telephone connectivity, and media playback. Additional functions may include:
The Vehicle is delivered without third-party applications (including browsers, map applications, radio applications or other third-party software) pre-installed. Any third-party software installed after delivery is installed at your request by an authorised dealer or another service provider. Such software is subject to separate third-party terms, and ASTRAUX does not control or assume responsibility for such software.
The current version of the In-Vehicle System does not include an embedded ASTRAUX navigation service, built-in third-party map application (such as Google Maps), or any other integrated navigation or mapping functionality.
The In-Vehicle System does not include built-in mobile data connectivity. Functions requiring an internet connection (including but not limited to certain connected features) require you to provide a compatible network connection, such as a mobile hotspot from your personal device. You are responsible for all mobile data, roaming and telecommunications charges incurred in connection with your use of the Functions.
The In-Vehicle System is equipped with a 32GB onboard storage capacity. This storage is reserved for system operation and future functional extensions. Users do not have direct access to this storage for personal file storage.
The current version of the In-Vehicle System does not require you to register or log in to an ASTRAUX user account. The In-Vehicle System itself does not collect, store or transmit any personal data directly. Any personal data that may be processed in connection with the Vehicle is handled through the Vehicle's separate T-Box and is described in the ASTRAUX In-Vehicle Privacy Notice and Vehicle Data Notice.
The precise Functions available depend on the Vehicle model, configuration, hardware, software version, country, network availability and technical compatibility.
The Vehicle may contain a separate built-in T-Box that communicates with ASTRAUX or its technical service providers independently from the In-Vehicle System.
The T-Box may support functions such as:
Vehicle data generated through the T-Box (including parking location and trip records) is stored on servers located within the European Economic Area.
Data processed through the T-Box is associated with the Vehicle itself, not directly with an identified individual. Further information about the data generated or transmitted through the Vehicle and the T-Box is provided in the ASTRAUX In-Vehicle Privacy Notice and, where applicable, the ASTRAUX Vehicle Data Notice.
The T-Box may continue to operate even when the In-Vehicle System is not connected to a mobile hotspot.
Certain Functions depend on:
You are responsible for:
ASTRAUX does not control the coverage, speed, quality or continued availability of a network or internet service provided by a third party.
You may connect a compatible mobile device to the In-Vehicle System through Bluetooth.
Depending on the permissions granted on your mobile device, Bluetooth functions may allow the In-Vehicle System to access or display:
You should grant only the permissions necessary for the Functions you intend to use.
You may remove a paired device or revoke permissions through the Vehicle settings or the settings of your mobile device.
Bluetooth pairing records or other locally stored connection information may remain in the Vehicle until you delete the relevant record or reset the In-Vehicle System.
You must not connect another person’s device, access another person’s communications or synchronise another person’s information without appropriate authorisation.
The Vehicle is not necessarily delivered with third-party applications pre-installed (including but not limited to web browsers, map applications, radio applications, or other third-party software).
An authorised dealer or another service provider may, at your request, assist with the installation or configuration of third-party software after delivery of the Vehicle.
Unless ASTRAUX is expressly identified as the provider of the relevant application or service:
Assistance by a dealer with installation does not, by itself, mean that ASTRAUX endorses the third-party service or assumes responsibility for its independent acts or omissions.
ASTRAUX remains responsible for matters that cannot lawfully be excluded and for any defect in the In-Vehicle System that is attributable to ASTRAUX rather than to the independent third-party service.
You must use the Functions safely, responsibly and in compliance with applicable road traffic and vehicle safety laws.
In particular, you must not:
The driver remains responsible for controlling the Vehicle, observing the road environment and complying with applicable traffic laws.
Passengers may use available infotainment functions only where doing so does not distract or interfere with the driver.
Where the Vehicle provides a pet mode or another climate-related function, that function is intended to support the maintenance of the Vehicle’s interior environment while the Vehicle is parked.
The function is not a substitute for responsible supervision or compliance with animal welfare, child safety or public safety laws.
Before relying on the function, you must verify that:
You must not leave a child, vulnerable person or animal unattended in the Vehicle where doing so is unsafe or unlawful.
Nothing in this clause excludes liability for a defect in the Vehicle or Function where such liability cannot lawfully be excluded.
The In-Vehicle System and related vehicle software may require updates, repairs or maintenance in order to:
The current Vehicle configuration does not generally allow the user to install ASTRAUX system updates through a user-operated over-the-air (OTA) update function.
All system updates may therefore need to be installed by an authorised repair centre, maintenance centre or other authorised technical service provider.
Where an update is necessary to maintain vehicle safety, cybersecurity, legal compliance or contractual conformity, ASTRAUX or the relevant authorised service provider may notify you that the Vehicle should be brought to an authorised location within a specified period.
You should follow reasonable update, recall, repair and maintenance instructions communicated by ASTRAUX, the seller, an authorised dealer or a competent authority.
ASTRAUX will provide updates and related information in accordance with applicable law. Failure to install an update within a reasonable period after clear notice may affect the availability, security or performance of a Function. It will not reduce your statutory rights where the failure to install the update is attributable to inadequate installation instructions, lack of reasonable access to the update or another matter for which ASTRAUX or the seller is responsible.
You must not install unauthorised firmware, security modifications or software that may compromise the safety, security or normal operation of the Vehicle.
ASTRAUX may modify a Function where there is a valid reason, including:
Where required by applicable law, ASTRAUX will inform you in advance of a modification that negatively affects your access to or use of a Function.
A modification will not reduce the conformity, safety or essential functionality of the Vehicle or a paid digital service unless permitted by applicable law and justified by a valid reason.
Where applicable law gives you a right to terminate a separately supplied digital service because of a material adverse modification, you may exercise that right without charge.
Changes to optional Functions do not affect your separate rights under the Vehicle purchase agreement, warranty terms or applicable consumer law.
The availability and performance of the Functions may be affected by:
ASTRAUX does not guarantee uninterrupted availability of functions that inherently depend on third-party networks or services.
However, nothing in these Terms limits ASTRAUX’s or the seller’s obligation to provide a Vehicle, embedded digital content or related digital service that conforms to the applicable contract and mandatory law.
Where a Function fails, you should stop using the affected Function if continued use may create a safety or security risk and contact an authorised service provider.
You are responsible for:
You must not:
Nothing in these Terms prohibits reverse engineering, interoperability testing, security research, repair or another activity to the extent that the activity is expressly permitted and cannot lawfully be restricted under applicable law.
ASTRAUX processes personal data in connection with the Functions in accordance with the ASTRAUX In-Vehicle Privacy Notice and applicable data protection law.
The Privacy Notice explains, among other matters:
The Privacy Notice provides information about personal data processing. It does not form a contractual request for consent to processing that is based on another legal basis.
Where consent is legally required for an optional Function, ASTRAUX will request that consent separately.
Certain vehicle-generated data may also be subject to access and sharing rights under the EU Data Act or other applicable data laws. Those matters are addressed separately in the ASTRAUX Vehicle Data Notice.
The In-Vehicle System may store information locally, including:
Persons using the same Vehicle may be able to view locally stored information left by a previous user.
You should therefore avoid storing information that you do not wish other authorised users of the Vehicle to access.
The Vehicle owner or primary user should establish appropriate practices for the management of connected devices and locally stored data where the Vehicle is shared by multiple users.
Before selling, leasing, renting, returning or otherwise transferring possession of the Vehicle, you should:
The previous user must not attempt to access the Vehicle or its locally stored information after the transfer.
The new owner or lawful possessor may be required to provide reasonable evidence of ownership or authority before connected vehicle records or permissions are changed.
ASTRAUX is not responsible for disclosure of locally stored information resulting solely from a user’s failure to remove that information before a transfer, except to the extent that the disclosure results from a defect or matter for which ASTRAUX is legally responsible.
The In-Vehicle System, embedded software, interface designs, graphics, icons, text, audio, software code, databases, trademarks and other materials made available by ASTRAUX are protected by applicable intellectual property laws.
Subject to these Terms, ASTRAUX grants you a limited, non-exclusive, non-transferable and non-sublicensable right to use the In-Vehicle System as installed in the Vehicle for personal or internal business use.
This right does not transfer ownership of any software or intellectual property to you.
You may not copy, distribute, sell, license, commercially exploit or create derivative works from ASTRAUX software or content, except where expressly permitted by ASTRAUX or applicable law.
The In-Vehicle System may contain open-source software. Open-source components are governed by the applicable open-source licences. Where required, relevant notices and licence terms will be made available through the In-Vehicle System, product documentation or another appropriate channel.
The Vehicle and the In-Vehicle System may be covered by:
These Terms do not replace or reduce those rights.
Where the In-Vehicle System or a related digital service fails to conform to the applicable contract, you may be entitled to repair, restoration of conformity, replacement, price reduction, termination or another remedy under applicable law.
Any statement in these Terms concerning technical limitations, third-party dependencies or availability must not be interpreted as excluding responsibility for a lack of conformity, defective product, failure to provide a legally required update or another liability that cannot lawfully be excluded.
Commercial warranty rights, if any, are described separately in the applicable warranty documentation.
ASTRAUX is responsible for loss or damage caused by a breach of these Terms or another legal obligation in accordance with applicable law.
Nothing in these Terms excludes or limits liability for:
Where ASTRAUX breaches an essential contractual obligation through ordinary negligence, liability may, to the extent permitted by law, be limited to loss that was reasonably foreseeable at the time the contract was entered into.
ASTRAUX is not responsible for loss caused solely by:
except where ASTRAUX contributed to the loss or remains liable under mandatory law.
This clause does not affect your statutory consumer remedies.
ASTRAUX may temporarily restrict or suspend a Connectivity Function where reasonably necessary to:
Any restriction or suspension will be proportionate to the relevant risk and limited to the extent reasonably necessary.
Where practicable and legally permitted, ASTRAUX will provide advance notice or notify you promptly after the suspension.
Suspension of an optional Connectivity Function will not prevent the operation of essential driving functions unless such restriction is necessary to address an immediate safety risk or is required by law.
These Terms apply while you use the Functions or lawfully possess the Vehicle.
You may stop using an optional Function at any time.
Where a separately supplied connected service may be terminated, the applicable termination method will be stated in the relevant service terms or product interface.
ASTRAUX may terminate or permanently disable an optional service only where:
Where required by law, ASTRAUX will provide reasonable advance notice and information about available remedies.
Termination of an optional connected service does not terminate the Vehicle purchase agreement and does not affect rights that have already accrued.
Provisions concerning intellectual property, liability, locally stored data, governing law and other matters that by their nature should survive will continue after termination.
ASTRAUX may update these Terms to reflect:
The version stored in the Vehicle reflects the Terms applicable as of the date stated at the beginning of the document.
The latest version will be available at our official legal portal (https://astraux.com/pages/astraux-in-vehicle-system-terms-of-use).
Where a change materially affects your contractual rights or use of a Function, ASTRAUX will provide reasonable notice through an available channel, such as:
A material change will not apply retroactively to your detriment unless required by law or necessary to address an immediate safety or cybersecurity risk.
Where applicable law requires your express consent to a change, the change will not take effect until the required consent has been obtained.
If you are a consumer, these Terms are governed by the laws of France.
This choice of law does not deprive you of the protection provided by mandatory provisions of the law of the country in which you habitually reside.
You may bring legal proceedings before the courts of your habitual residence or another court having jurisdiction under applicable law.
If you are acting for purposes relating to your trade, business, craft or profession, these Terms are governed by the laws of France and any dispute that cannot be resolved amicably will be submitted to the competent courts of Paris, France, unless mandatory law provides otherwise.
Before commencing proceedings, you may contact ASTRAUX using the details below so that the parties may attempt to resolve the matter.
These Terms govern the Functions within their stated scope. Separate vehicle sale, lease, warranty, repair, App, privacy, data access or third-party terms may also apply.
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be interpreted or replaced to the minimum extent necessary to comply with applicable law.
A failure or delay in enforcing a provision does not constitute a waiver of that provision or any other right.
ASTRAUX may transfer its rights and obligations under these Terms as part of a corporate reorganisation, business transfer or transfer of the relevant vehicle services, provided that the transfer does not reduce your mandatory rights.
You may transfer rights associated with the In-Vehicle System together with lawful ownership or possession of the Vehicle, subject to these Terms and applicable law.
These Terms may be made available in multiple languages.
Where mandatory law requires a local-language version, that version will apply to users in the relevant jurisdiction to the extent required by law.
Any provision stating that one language version prevails will not limit rights arising from mandatory consumer information or language requirements.
Notices may be provided through the In-Vehicle System, the ASTRAUX website, the ASTRAUX mobile application, an authorised dealer or repair centre, email or another durable medium, depending on the nature of the notice and available contact details.
